This Privacy Policy explains how Betooned (“Betooned”, “we”, “us”) collects, uses and protects personal data when you visit betooned.co (the “Website”) or contact us about a project. We follow the EU General Data Protection Regulation (GDPR), the French Data Protection Act (Loi Informatique et Libertés) and applicable US state privacy laws, including the California Consumer Privacy Act as amended by the CPRA (CCPA).
1. Who is responsible for your data
The controller of your personal data is Betooned, represented by Sasha Potapova. For any question about this policy or your data, write to be@betooned.co.
Data you give us: when you fill in the project brief form or write to us by email, WhatsApp, Instagram, Behance or LinkedIn, we receive your name, e-mail address and whatever you choose to tell us about your project (summary, budget, deadline) and any other information in your message.
Data collected automatically: our hosting provider records technical data needed to deliver the Website securely (IP address, browser type, pages requested, date and time). If you accept analytics cookies, Google Analytics collects information on how you use the Website (pages viewed, approximate location at city level, device and browser type, referring site). We do not collect special categories of data and ask you not to send them to us.
To reply to your enquiry and prepare a proposal — steps taken at your request before entering into a contract (Art. 6(1)(b) GDPR). To perform our contract with you if we work together (Art. 6(1)(b)). To keep the Website secure and working — our legitimate interest (Art. 6(1)(f)). To measure the audience of the Website with Google Analytics — only with your consent (Art. 6(1)(a)), which you can withdraw at any time. To comply with legal obligations such as accounting rules (Art. 6(1)(c)).
We do not use your data for automated decision-making or profiling, and we do not send marketing e-mails unless you have asked for them.
The Website uses no advertising cookies. Analytics cookies from Google Analytics are set only after you click “Accept” in the cookie banner. If you click “Decline”, no analytics cookies are placed. Your choice is stored in your browser for 6 months; you can change it at any time with the “Cookie settings” link at the bottom of this page or by clearing your browser data. Videos are embedded from Vimeo and YouTube; these services may set their own cookies when you play a video, under their own privacy policies.
Your data is accessed only by the Betooned team members who need it to handle your request. We use trusted service providers acting on our instructions: our website hosting provider (Namecheap, Inc., USA), our e-mail provider, and Google Ireland Ltd / Google LLC for Google Analytics (only if you consent). We never sell or rent your personal data.
Some of our providers are located outside the European Economic Area, in particular in the United States. Such transfers rely on the EU–US Data Privacy Framework where the provider is certified, or on the European Commission’s Standard Contractual Clauses, together with additional safeguards where necessary.
Enquiries that do not lead to a project: up to 3 years after our last contact. Client data: for the duration of the contract and then as long as required by law (for example, 10 years for accounting documents in France). Server logs: up to 12 months. Google Analytics data: 14 months. Your cookie choice: 6 months.
You have the right to access your data, to have it corrected or erased, to restrict or object to its processing, to data portability, and to withdraw your consent at any time without affecting earlier processing. You may also give instructions on what happens to your data after your death. To exercise your rights, write to be@betooned.co; we will answer within one month. You can lodge a complaint with the French data protection authority, the CNIL (www.cnil.fr), or with the authority of your country.
In the last 12 months we have collected the categories of personal information described in section 2 (identifiers, internet or other electronic network activity, and the commercial information you share about your project) for the purposes described in section 3. We do not sell personal information and do not share it for cross-context behavioral advertising, and we honor Global Privacy Control signals. Depending on your state of residence, you have the right to know, access, correct and delete your personal information, and not to be discriminated against for exercising these rights. To make a request, write to be@betooned.co; we will verify your request using the contact details you have given us. An authorized agent may act on your behalf with your written permission.
The Website is intended for businesses and adults. We do not knowingly collect personal data from children under 16. If you believe a child has sent us personal data, please contact us and we will delete it.
We use appropriate technical and organisational measures to protect your data, including encrypted connections (HTTPS) and restricted access. No method of transmission over the Internet is completely secure, but we work to protect your information and to notify you where the law requires it.
We may update this policy. The current version is always published on this page with the date of the last update. If changes are significant, we will make this clear on the Website.
